From experience, we have determined several Required Tenant Screening Criteria that must be met for any potential tenant application to be approved.  Once a tenant has met the Required Tenant Screening Criteria, they are approved and additionally scored on certain thresholds of several of the factors above, to determine the amount of the security deposit that will be required of the potential tenant.

The process for tenant screening is one of the areas that produces a significant amount of lawsuits against property owners – because many property managers do not know the law.  Tenant screening is governed by both Federal and Texas laws and orders of both Federal and Texas agencies.  In addition to the Federal Fair Housing Act (https://www.justice.gov/crt/fair-housing-act-2), the Texas Fair Housing Act (http://www.statutes.legis.state.tx.us/Docs/PR/htm/PR.301.htm), and the Texas Property Code, there are numerous Executive Orders of the Department of Housing and Urban Development and additional Federal and Texas legislation which may apply and provide a basis for litigation.
